To the maximum extent permitted by applicable law, we exclude all representations, warranties, and conditions relating to our website and the use of this website (including, without limitation, any warranties implied by law in respect of satisfactory quality, fitness for purpose and/or the use of reasonable care and skill). 

Nothing in this disclaimer will:

1. Limit or exclude our or your liability for death or personal injury resulting from negligence;
2. Limit or exclude our or your liability for fraud or fraudulent misrepresentation;
3. Limit any of our or your liabilities in any way that is not permitted under applicable law; or
4. Exclude any of our or your liabilities that may not be excluded under applicable law.

The limitations and exclusions of liability set out in this Section and elsewhere in this disclaimer: (a) are subject to the preceding paragraph; and (b) govern all liabilities arising under the disclaimer or in relation to the subject matter of this disclaimer, including liabilities arising in contract, in tort (including negligence) and for breach of statutory duty.

To the extent that the website and the information and services on the website are provided free of charge, we will not be liable for any loss or damage of any nature.

Unless instructed to ship a complete order Discount Hardware Direct LLC ships whatever material is available and back orders the balance. Discount Hardware Direct LLC is not accountable for damage occurring due to circumstances beyond our control. Changes to the order can only be made within 4 hours from signing the document without any fees, unless the items are shipped. 

By signing below, the Buyer acknowledges and accepts Terms and Conditions of Discount Hardware Direct LLC. 

Under no circumstances Discount Hardware Direct LLC is liable for any amount exceeding the cost of the Goods. Discount Hardware Direct LLC is not responsible for transportation, shipping, removal, labor, or installation/assembly charges or costs occurred for replacing the Product or any other costs relating to the replacement of the Product. Discount Hardware Direct LLC is not responsible for any loss of the customer due to increased production or delivery time. 

All door units are shipped in a knocked down condition (not pre-hung) unless otherwise stated in the order. All furniture is shipped in a non-assembly condition and requires assembly by a professional.

Once a shipment/delivery is received, the Buyer should inspect the contents of each package before signing the bill of lading. All visible damage should be noted on the bill of lading, however, it is also important to open all received boxes and inspect the Products for any concealed damage at the time of delivery. 

If the driver does not allow the Buyer to inspect the freight, please note it on the bill of lading. All damage should be reported to Discount Hardware Direct LLC within 3 (three) days from the shipment/delivery date. Failure to comply with these rules will disqualify the Buyers from the merchandise replacement. 

Shop items and special orders cannot be cancelled once the manufacturing process has begun. All cancellations and changes to the order are subject to production and/or material charges occurred prior to the cancellation or change request. While Discount Hardware Direct LLC makes every effort to honor cancellation and change requests, the order is considered firm after signing the document, and the Buyer is liable for the full price of the order. 

Special orders are non-stock items and are non-returnable/refundable. The merchandise altered in a special way is non-returnable/refundable. Pre-hung or mortised merchandise is non-returnable/refundable. 

All local pick- up orders should be picked up within 7 days after notification. Otherwise a storage fee of 50$ per day will be charged. No returns are accepted unless previously authorized by Discount Hardware Direct LLC in writing or by email. The Buyer understands and accepts a restocking charge of 20% of the Invoice amount. Shipping costs are not refundable. A storage fee by the shipping carrier, if the delivery is unsuccessful, could be charged, which the fee depends on the carrier itself. These fees would be transferred by Discount Hardware Direct LLC to the Buyer. 

All returns should be in merchantable condition, and in the same packaging and/or wrapper condition as purchased. All returned Goods are subject to warehouse inspection before the credit is issued. The Buyer should provide proof of purchase for all returned Goods. No Goods are accepted for the return after 45 calendar days. In order to fulfill requests on parts, photos of the damaged/defective parts or items are required. The Buyer should fill out the Claim form and attach the photos to it. Discount Hardware Direct LLC determines the best solution and file a damage claim to the shipping company. Discount Hardware Direct LLC shall not be responsible for indirect, consequential, or incidental damage.

Delivery options:

• Shipping & Handling Job Site - delivery to a non-residential area with loading dock or fork lift access;
• Shipping & Handling Residential - Includes a curb side delivery with a lift gate service;
• Delivery - Curbside delivery;
• Inside Delivery - Merchandise will be brought into the ground floor/garage;
• White Glove Delivery - unpackaging & disposal of packaging materials & transporting up or down of maximum of two flight of stairs.

WE DO NOT WARRANT, ENDORSE, GUARANTEE, OR ASSUME RESPONSIBILITY FOR THE ACCURACY OR RELIABILITY OF ANY INFORMATION OFFERED BY THIRD-PARTY WEBSITES LINKED THROUGH THE SITE OR ANY WEBSITE OR FEATURE LINKED IN ANY BANNER OR OTHER ADVERTISING. WE WILL NOT BE A PARTY TO OR IN ANY WAY BE RESPONSIBLE FOR MONITORING ANY TRANSACTION BETWEEN YOU AND THIRD- PARTY PROVIDERS OF PRODUCTS OR SERVICES.
